According to court documents obtained by Us Weekly on Tuesday, January 20, Slate, 43, apologized to her It Ends With Us costar Lively, 38, after the actress made what she called an “inappropriate” joke.
“I truly am SO SORRY that I made that remark about our tiny bedroom in our s****y airbnb. I think back on it now, referencing that it was ‘bad for sex’ and just realizing that this is way inappropriate to say,” Slate allegedly wrote on May 29, 2023. “I hope that you know that I know that it wasn’t the setting for that kind of remark, and also now knowing that you guys sleep as a fam, it must have just seemed like such a bummer judgment. I’m so sorry. I def have no judgment on it, but I’m sure it seemed that way.”
Lively and her husband, Ryan Reynolds — who share James, 11, Inez, 9, Betty, 6, and Olin, 2 — have previously shared a glimpse into their sleeping situation.

“Our kids can’t even go to sleep unless they’re in our bed,” Reynolds, 49, said during a July 2024 episode of the “Not Skinny But Not Fat” podcast. “As much as I’d say I’d love to spread out and fall asleep normally, I withhold that.”
According to court docs, Lively responded to Slate saying it was “so not necessary” to apologize. Instead, it was Baldoni’s comments that appeared to bother her.

And there is a safety with women that there isn’t with men,” Lively allegedly wrote. “They had screwed you on your living situation and you had to ask for something better. So casually making a joke about sex was likely a subconscious way of playing to your audience. If the guy who could authorize moving could empathize, then you and your family would be outta there. It all tracks.”
Lively continued, “Also, in the moment, it actually wasn’t you that was strange. It was JB. You didn’t know we all sleep in bed together. He did. And when you said that, he said, ‘Oh yeah, terrible for sex.’ It was so odd that he said that instead of just laughing like I did.”
According to Lively, Baldoni, 41, is “always trying to be liked and so joining makes sense for him.”
“It was still something I clocked on his part,” she added. “Because I know we all sleep in the same bed obviously.”

Although a judge advised both parties to consider settling the case, the trial is slated to begin on May 18, 2026, in New York.
