Lucy Letby will face no further criminal charges following a police investigation into claims she harmed more babies while working as a neonatal nurse.

Letby, 35, is serving 15 whole life terms after being found guilty of murdering seven babies and attempting to murder seven more at the Countess of Chester hospital between 2016 and 2017.

She has always maintained her innocence but has twice had applications against her convictions rejected by the courts.

Cheshire Police has continued to investigate the “full footprint” of Letby’s career as a nurse which dates back to 2012 and also included a stint at Liverpool Womens’ Hospital.

Detectives on Operation Hummingbird submitted a file of evidence to the Crown Prosecution Service in July 2025 with the intention that she would be charged further offences against nine babies, including two further counts of murder.

But today Cheshire Police announced the CPS has decided their evidence does not meet the threshold for further criminal charges.

“This is not the outcome that we had anticipated throughout our investigation; we were confident that we held enough evidence to take to the CPS,” the force said.

“We believed the evidence submitted met the CPS charging standard.  The CPS did not agree and despite our representations we must respect the decision that has been made.

“There will be some who will feel that this is news worth celebrating. We do not share this view and would ask that people respect the privacy and feelings of the families involved.”

“We are deeply grateful to the experts and witnesses who have contributed to this investigation. Their input has been invaluable in answering many difficult questions on behalf of the families.

“Today’s announcement does not affect or undermine the convictions of Lucy Letby for multiple murders and attempted murders of premature babies following an extensive investigation and two criminal trials, including one of the longest running murder trials in British criminal history and two unsuccessful appeals.

“This decision by the CPS will have no impact on Operation Duet – our ongoing investigation into corporate manslaughter and gross negligence manslaughter at the Countess of Chester Hospital. These remain separate investigations.

“Our thoughts remain with the families affected by this.”

Letby is now represented by barrister Mark McDonald who has submitted a fresh application to have her convictions examined by the Court of Appeal.

It is currently being assessed by independent watchdog the Criminal Cases Review Commission which has said it cannot offer a timeline as to when it will make a decision.

“Lucy Letby has always maintained her innocence – she has never hurt a child and never would,” McDonald said.

“31 reports have been submitted to the CCRC, compiled by 26 internationally renowned experts, which provide overwhelming evidence that no babies were murdered. The reality is that a young innocent woman is in prison for crimes she has not committed.”
