A teen has filed a lawsuit saying she was assaulted at a fraternity party at the University of Chicago, marking the latest allegation after a recent incident was reported earlier this month.
The 19-year-old woman said in the lawsuit she was raped in February at the Alpha Delta Phi fraternity in “the latest in a string of sexual assault reports at the house” that the complaint says “stretches back more than 15 years.”
Identified only as Jane Doe, the teen said she attended a party at the frat house when a male member of the group “took her into a room, led her to a bed and raped her.”
The complaint alleges the man “raped her while she was unable to consent, then left her unconscious in the room, where a friend later found her,” her attorneys said.
“She struggled to speak and walk as friends helped her out of the house. The next morning, she discovered bloodstains on her underwear and reported the assault to Chicago Police. That investigation remains open,” her attorneys said in a release following the lawsuit’s filing.
The complaint follows allegations from a woman who said she was assaulted in a bathroom of a fraternity party just one block away at Alpha Epsilon Pi earlier this month. A police investigation is ongoing in that case.
Meanwhile, a lawsuit at Loyola University that was the focus of an NBC 5 Investigates report is now sparking protests on campus after 10 former students accused the university of failing to properly respond to reports of sexual assault.
In a separate case in New York, a woman alleged she was drugged and gang raped by members of the Chi Phi fraternity at Cornell University.
In her complaint filed on Monday, Jane Doe alleged the Alpha Delta Phi chapter faced numerous police investigations for sexual assault reports over the years and failed to prevent such incidents from happening.
“Alpha Delta Phi has been on notice about this house since 2009,” Michael Grieco, GGH Founding Partner, said in a statement. “Report after report, investigation after investigation — and a young woman was still raped there this year. What did the national organization do with those warnings? Were changes made? Was anyone held accountable? Those are the questions Alpha Delta Phi now has to answer under oath.”
Though the complaint acknowledges the national fraternity offers information aiming to prevent such assaults, it alleges the organization “failed to enforce its own policies on alcohol, consent and supervision at chapter events.”
The fraternity did not immediately respond to NBC Chicago’s request for comment.
The University of Chicago, which is listed in the suit as a “respondent in discovery,” has said that fraternities are “not recognized student organizations and have no formal affiliation with the university.” The university did not respond to requests for comment following the latest allegation.
“Universities say fraternities operate outside their oversight. That makes the national organization’s role all the more important,” Grieco said. “Alpha Delta Phi charters this chapter, sets the rules inside this house and has the power to enforce them — or shut the chapter down. That responsibility doesn’t end at the front door.”
The complaint seeks damages for Jane Doe’s “physical injuries, emotional distress and ongoing psychological harm.”
