LYONS, N.Y. — Charlene Childers, the woman who pleaded guilty to planning the killing of her children’s father and his fiancée in Sodus, is due in court on Wednesday for a resentencing hearing.
Childers was sentenced to 28 years in prison after pleading guilty to manslaughter in the 2018 deadly shooting of Josh Niles and his fiancée, Amber Washburn. The shooter, her husband Tim Dean, is serving a sentence of life in prison without parole. Dean was also a former police chief in Sunray, Texas.

Childers applied to be resentenced under New York’s Domestic Violence Survivors Justice Act. According to the New York State Bar Association, the law allows prosecutors and defense attorneys to look back at cases where a defendant was a documented victim of abuse.
Childers says the domestic violence she experienced should have been considered during her sentencing. Now, the court must decide if her experiences meet the criteria under the domestic violence survivors law.
“Based on the fact that she was allowed to plead guilty to a manslaughter charge, she could actually technically receive what would be a time-served sentence,” Wayne County District Attorney Christine Callanan said. “So, it would be up to five years. So she could technically, if she were sentenced, be given basically time served, she would be released, potentially.”
