BUFFALO, N.Y. — The New York Attorney General has closed its criminal case into the death of a refugee in Buffalo citing lack of jurisdiction over Border Patrol agents.

News10NBC’s affiliate in Buffalo reports the AG’s Office said it will pursue a civil investigation to examine systemic issues.
The refugee, 56-year-old Nurul Amin Shah Alam, was found dead this past February, days after being released to Border Patrol and left at a closed coffee shop.
Shah Alam was initially arrested in February 2025 in a backyard in Buffalo, being jailed for a year at the Erie County Holding Center.
When Shah Alam was released on Feb. 19, 2026, days before he went missing, Border Patrol agents reportedly dropped him off at a closed Tim Hortons. According to our affiliate, Border Patrol has said Shah Alam “showed no signs of distress, mobility issues, or disabilities requiring special assistance,
The Erie County District Attorney’s Office says its criminal investigation remains ongoing.
