The family of a woman killed boat crash on the Fox River last month plans to file a wrongful death lawsuit Thursday, with lawyers calling the incident that left 48-year-old Magdalena Jablonska dead a “horrific, tragic, avoidable accident.”
Jablonska’s fiancé was also injured in the crash, which occurred the afternoon of July 25 along the Fox River south of the McHenry Dam in McHenry. Richard Stevenson, of Lisle, faces multiple charges in the case, including DUI and reckless homicide.
Prosecutors say Stevenson was traveling at 80 mph when he slammed his high-powered pontoon into the boat Jablonska was riding in while both vessels were in a slow zone.
According to McHenry County State’s Attorney Randi L. Freese, Stevenson’s 31-foot pontoon rode over Jablonska’s 20-foot Crownline before coming to a stop on land.
Authorities said Stevenson’s blood alcohol content was more than twice the legal limit when the crash occurred. Multiple witnesses said they saw Stevenson drinking alcohol throughout the day while driving at high rates of speed on both the Chain O’ Lakes and the Fox River before the crash.
According to prosecutors, Stevenson was charged with Driving Under the Influence of Alcohol on three prior occasions. He had also been charged with Reckless Driving on three prior occasions and four misdemeanor speeding offenses.
During a detention hearing last month, McHenry County States Attorney Deputy Chief Brian Miller described Stevenson as a “ticking time-bomb.”
“Our job is to find true justice, and it’s not just the person that was behind the wheel,” said Mike Krauss, the attorney representing Jablonska’s family. “It’s everyone who put a hand on the decision and the circumstances of this horrific, tragic, avoidable accident.”
A press conference about the lawsuit with GWC Injury Lawyers LLC is scheduled to take place Thursday morning.
