A lawsuit filed this week in Federal Court claims that Customs and Border Protection Officers violated the 4th Amendment rights of a Lakeview man when they swarmed his property trying to make immigration arrests in October of 2025.
Leo Feler was out of the country running the Toronto Marathon while a windows and siding company was working on his historic house. He said his Ring cameras alerted him to a raid in progress when one of the workers pushed the doorbell to trigger the cameras.
“Here it was a crew of Hispanic workers, and these masked, armed men just jumped my fence to chase after them,” Feler said.
On the video, agents can be seen jumping fences, climbing onto balconies and trying to grab one man who had scrambled through one of the windows he was installing to get inside. All the while Feler’s tenant can be heard asking the officers for a judicial warrant to enter and asking the CBP agents to leave.
“At no point did they show a warrant or even identify who they were,” said Feler, who could also be heard on the video demanding that officer leave his over the camera’s loudspeaker.
On Tuesday, Feller filed a lawsuit in federal court alleging that the officers conducting the raid violated his constitutional protection from unreasonable search and seizure.
“You can’t just follow every hunch and walk on every piece of private property that you want just because you are a law enforcement officer. That’s the whole reason we have the fourth amendment,” said Dylan Moore of the Institute for Justice which is representing Feler in the case. “Hiring people to renovate your house is not a license for federal agents to raid it,” he said.
Of the four people working on the house at the time, only one man was detained. He was later ordered to be released by a federal judge.
Even though he wasn’t a target of the raid, Feler said he felt he had to bring the lawsuit to speak up on behalf of others whose rights were not respected by the Trump Administration’s Operation Midway Blitz enforcement action.
“If anyone is going to be able to stand up and say ‘this isn’t right’ or ‘we need an investigation to see if these agents acted correctly…if this government acted incorrectly,’ that would be me,” Feler said.
Before they backed away from the tense scene, CBP agents deployed tear gas on the crowd.
A spokesperson for Customs and Border Patrol said in a statement: “Enforcing immigration law is the mission of the Department of Homeland Security and is essential to protecting America’s national security, public safety, and economic strength. Operations are conducted within the authority granted to immigration officers under Title 8. Immigration officers act in accordance with the U.S. Constitution and other applicable laws when investigating immigration status and making arrests.”
The government has 90 days to either respond to Feler’s lawsuit or ask a judge to dismiss the case.
