ALBANY, N.Y. — Catholic healthcare providers and religious orders are suing to block New York’s Medical Aid in Dying Act, claiming it violates their constitutional rights.
The law, which Gov. Kathy Hochul officially signed into state law in February, will allow doctors to prescribe a pill to end the life of a person with a terminal illness.
According to the Albany Times Union, the lawsuit, filed in U.S. District Court in Albany, argues the law forces religious institutions to participate in physician-assisted death despite their beliefs. Plaintiffs want a temporary restraining order and a ruling that the law is unconstitutional.
The Times Union says the lawsuit says the bill violates their First Amendment protections, stating New York is forcing religious institutions to pick between following their beliefs and remaining in compliance with the law.
Medical staff don’t have to participate in providing aid in dying if they don’t feel comfortable doing so. Under the bill, doctors, nurses, pharmacists, or anyone involved in the process can decline to help at any point.
However, like in all other medical cases, they do have to transfer relevant records to a new medical provider if the patient asks. The bill also does not force insurance to cover aid in dying.
The law is set to take effect on Aug. 5.
