SAN LUIS OBISPO, Calif. (KEYT) – Robert Wade Moore IV was convicted of robbery, assault, and resisting arrest after beating a 67-year-old Smart & Final employee who confronted the 40-year-old for stealing back in December of last year.

According to the San Luis Obispo County District Attorney's Office, the jury found Moore guilty of robbery, two counts of assault, and resisting arrest, acquitted the 40-year-old on lesser offenses and elder abuse, and was unable to reach a verdict on his charge of carrying a concealed dirk or dagger.

Following the jury's decisions, the presiding Judge in this case found true the following aggravating factors that will be used during Moore's sentencing currently scheduled for August 12 of this year where he faces a maximum of five years in state prison the local prosecutor's office shared:

On December 22, 2025, a 67-year-old Smart & Final employee was working in the produce area of the Johnson Avenue location in San Luis Obispo when he spotted Moore carrying several food items towards the cart area when Moore stopped in front of the Martinelli's cider display detailed the San Luis Obispo County District Attorney's Office.

Moore grabbed a three-pack of apple cider and walked out of the store without paying noted the local prosecutor's office.

The 67-year-old employee followed Moore outside of the store and confronted him about the stolen items and when he attempted to grab the three-pack of cider, surveillance footage captured Moore throwing his items at the employee before he began to use the cider to strike the employee multiple times explained the San Luis Obispo County District Attorney's Office.

According to the San Luis Obispo County District Attorney's Office, a customer loading their groceries into their vehicle heard Moore yelling and beating the 67-year-old employee who was on the ground and they decided to run over and intervene.

Moore threw a milk container at the intervening community member before successfully fleeing the scene on a bicycle shared the San Luis Obispo County District Attorney's Office.

The next day, employees at the San Luis Obispo Ranch Market reported to law enforcement that a person had locked themselves in a bathroom and refused to come out when cleaning staff were trying to close detailed the local prosecutor's office.

Officers tried to convince the man to exit before using an override code to open the bathroom added the San Luis Obispo County District Attorney's Office.

While officers took the man, later identified as Moore, into custody, an officer spotted the tip of a knife protruding from Moore's right front pocket and a search of his person revealed the presence of another knife that was fully concealed in the same pocket noted the prosecutor's office.
