ROCHESTER, N.Y. — Smart glasses will be banned in all courts across New York State starting Monday. Anyone entering a courthouse will have to leave eyewear that contains cameras, microphones, or other recording technology at home. The ban applies to everyone, including court staff and attorneys.

Signs are already posted in and around the Monroe County Hall of Justice in Rochester, letting people know the ban starts July 20th. 

Court deputies in Monroe County have been keeping an eye out for what people are wearing over their eyes for a while now. “Being that they’re a new technology, there’s not many out there right now,” explains Lt. Jeffrey Ingham but the concern is growing statewide, “it’s another technology that in disguise, can record proceedings,” he adds.

While smart phones are allowed in most courtrooms, often the judge issues a reminder before proceedings start that they need to be kept off and put away. It’s much easier for deputies to see if someone is trying to discreetly record when they need to put their phone up to do it. It can be harder to tell whether smart glasses are recording. “there’s been concern, as technology is progressing, it’s another avenue people could use to record,” Lt. Ingham says.

So, starting Monday, deputies will be looking for smart glasses, “typically, it’s going to be addressed at weapon screening. As they come through weapon screening, deputies have been trained to identify what they look like, if there in someone’s package or your purse or whatever you have, it’s going to be seen on the x-ray machine,” explains Lt. Ingham.  If you don’t leave the glasses in the car or at home, you will be able to check them at security, “we’ll have the person just surrender it, we’ll give them a voucher for it and as they exit, they’ll pick it up on their way out.”

Even if you have smart glasses with prescription lenses in them, you will not be able to wear them inside any court across New York come Monday. The ban includes state, county, city, town, and village courts.

Meta says its smart glasses won’t take photos or video if the capture LED is covered. It’s also rolling out an update to disable the camera if it’s physically tampered with or destroyed. But it won’t matter in New York courts, because if you have smart glasses on at all, you’ll have to leave them at the door.
