Embattled U.S. Attorney Andrew Boutros was again forced to explain a big mistake in court on Thursday and was admonished by a federal judge for violating a court order in a murder case involving supposed Tren de Aragua gang members.
Fresh off of controversy over his handling of the ‘Broadview Six’ case, Boutros was summoned to federal court to explain why his leadership has come into question yet again after he violated a judge’s order and allowed information to go public in a criminal complaint that was supposed to have been sealed.
Boutros appeared with Acting Attorney General Todd Blanche and FBI director Kash Patel last Thursday to announce arrests in a kidnapping and murder case involving Tren de Aragua members and publicly revealed photos of the suspects – information that was ordered by Federal Magistrate Judge Laura McNally to have been sealed.
“A man kidnapped in a park in Chicago in broad daylight, beaten and taken against his will to an abandoned building and shot and left for dead in a bathtub,” Boutros said on July 1 at the Justice Department Headquarters while flanked by Blanche and Patel.
In Thursday’s hearing, McNally reminded Boutros that she ordered the sealing only because he and his prosecutors argued for it. They said two suspects were in custody but one was still at large, and un unsealing could compromise law enforcement. As of Boutros’ press conference, the suspect had not yet been caught, and the sealing was still in place.
“My intent was that this matter would be sealed and remained sealed until everyone that was arrested on this complaint or the order was rescinded,” McNally told Boutros.
Boutros responded that he had asked his prosecutors to file a motion to unseal the documents before boarding an early morning plane to DC to take part in the press conference on July 1. He says prosecutors told him that they were heading up to court to take care of it, and that’s the last he heard. He says he was not able to check email messages while in flight, nor in the 15 to 20 minutes while waiting in a green room before heading out to deliver his remarks. McNally says she never received a motion from prosecutors to unseal the criminal complaint.
“My intentions were never to not be in compliance with the court’s order,” Boutros told the judge, who warned him that he could not pass the blame off on his prosecutors.
Boutros agreed and said, “we are going to go back and look at this from a root cause perspective to see how we can do better and how we can avoid this.”
The third suspect in the Tren de Aragua case was eventually taken into custody on Friday of last week. The judge says Thursday’s hearing does not call into question the underlying merits of the case.
At least two senators and a host of local public officials have called on Boutros to resign previously for his handling of the now defunct ‘Broadview Six’ case.
The hearing on Thursday coincided with Boutros’ appointment to the counterespionage and research security subcommittee of the Attorney General’s Advisory Committee, the U.S. Attorney’s Office for the Northern District of Illinois announced.
“Among its various responsibilities, the CRS Subcommittee will focus on foreign bad actors who are infiltrating our research institutions, including colleges, universities, and corporations, to commit espionage, steal trade secrets and proprietary data, and bypass sanctions,” officials said.
