ALBANY, N.Y. — An independent review of New York State’s prison system is calling for more accountability for staff members to prevent the abuse of inmates.

The Department of Corrections and Community Supervision hired law firm WilmerHale and consulting group Falcon to review prison policies after the beating deaths of Robert Brooks and Messiah Nantwi, two inmates at different prisons in Marcy. Multiple prison guards have either pleaded guilty or been found guilty of charges connected to the death of Brooks, a Greece native, at Marcy Correctional Facility.

The nearly 300-page report analyzed past examples of prison guards using force, determining that there’s a culture of “no snitching” and a lack of willingness to intervene when force against inmates becomes excessive. The report describes staff at correctional facilities as a brotherhood with an “us vs. them” mentality against the incarcerated.

“These dynamics can undermine fairness and accountability. Only one former correction officer interviewed said that, had they been in the room during the fatal beatings of Mr. Brooks and Mr. Nantwi, they would have intervened. All others interviewed referenced cultural norms against intervening to stop fellow officers,” the report said.

The report also mentions that staffing shortages have made prison guards feel less safe and led to worse conditions for inmates. Staffing shortages were one reason for the statewide prison guard strikes in February and March of 2025. Because of the shortages, guards have faced mandatory overtime, and some mental health, educational, vocational, and recreational activities for inmates have been on hold.

“The increased pressure on staff and limitations on programming increase tensions at the facilities and heighten safety risks for staff members and incarcerated individuals,” the report said.

The report outlines multiple recommendations, including improving oversight of body-worn cameras, modernizing DOCCS record-keeping, creating a chief risk officer position, and updating training on de-escalation and guards’ duty to intervene.
