Prosecutors seek top-guidelines sentence exceeding eight years in prison Court filings reveal massive heads-up poker wins and losses Defense says severe gambling addiction drove Goldstein’s downfallFederal prosecutors last week asked for an eight-year and one month prison sentence for Tom Goldstein, the top Washington lawyer who led a double life as a high-stakes poker player.
Tom Goldstein, whose lawyers argue was in the grips of longstanding gambling addiction. Federal prosecutors allege his motivation was “pure, unrelenting greed.”. (Image: Wikicommons via Legaleagle22)Goldstein was convicted by a federal jury in Maryland in February of evading millions of dollars in taxes and of lying on mortgage applications.
As a lawyer, he argued more than 40 cases before the Supreme Court, with clients including Al Gore and Google.
As a poker player, he flew under the radar, playing in some of the biggest heads-up matches in the world involving stakes totaling millions, and even tens of millions, of dollars, according to court documents.
‘Unrelenting Greed’
In a sentencing memorandum filed in Maryland last week, prosecutors urged the judge to impose a sentence at the top of the guidelines range, repeatedly emphasizing Goldstein allegedly continued to violate tax laws after he learned he was under investigation, after he was indicted, and even after conviction.
Since 2021, Goldstein has continued to flout his tax obligations every year, going so far as filing a false tax return and not paying his taxes due in April 2026 – after he was convicted of nine federal tax crimes,” prosecutors wrote in the 84-page court filing.
They claim his motivation was “pure, unrelenting greed” – whether “funneling gambling income through offshore bank accounts, shaving millions off his true law firm income, or lying to his lenders, Goldstein’s crimes always sought to advance and maintain his exorbitant lifestyle, replete with Bentleys, globe-trotting vacations, and a $200,000 watch,” they wrote.
Tens of Millions Won and Lost
In 2016, Goldstein played a series of heads up matches against three ultra-wealthy opponents: US private equity billionaire Alec Gores and two Asian gamblers known as “the Chairman” and “Tango.”
The games yielded around $50 million in winnings for the lawyer, though he had sold 75% of his equity, according to court testimony.
When the chance came to play US real estate investor and private equity executive Bob Safai, Goldstein chose to stake himself entirely. He lost $14 million, court records show.
At the time of his arrest, he was engaged in a two-year series of heads-up matches with the billionaire Texas banker and legendary high-stakes player Andy Beal, according to court documents, and was ahead by $51.4 million.
‘Severe Addiction’
Meanwhile, Goldstein’s lawyers argued that any prison term would be excessive, emphasizing a legal career often driven by public service rather than profit. They also highlighted his gambling addiction, for which he is receiving treatment.
“The obvious reality overshadowing this case is that Mr. Goldstein has a severe and longstanding gambling addiction,” they wrote.
Mr. Goldstein was at the peak of his career. He was financially successful and well respected. He married his college sweetheart, started a small business with her in their home, and raised two children. He should be retiring with significant life savings …”
“Instead, he has spent many years gambling with money he didn’t have, and gambling away money that he won, to the detriment of himself and his loved ones,” they added.
