ROCHESTER, N.Y. — The Department of Justice is trying to dismiss the indictment of Rochester man Dominic Pezzola.
Pezzola was a member of the Proud Boys group at the time of the January 6 riot at the Capitol Building and was caught on camera smashing the building’s windows.

President Donald Trump already commuted Pezzola’s prison sentence last year, releasing him from prison. This comes a week after the Justice Department announced it will establish a nearly $1.8 billion fund it’s calling an “anti-weaponization fund” for people claiming the Biden administration weaponized the DOJ against them.
Last week, Pezzola’s attorney told News10NBC that Pezzola would have “valid claims” to seek a payout from that fund.
