The Trump Administration is making a near nationwide effort to seek access to detailed voter records, an effort that prompted the Department of Justice to sue more than half the states in the country after they refused to comply, including Illinois.

Federal officials say they are seeking the voter data because it’s their responsibility to “ensure that states have proper and effective voter registrations and voter list maintenance programs.”

If a state hands over their voter roll to the DOJ, the department will look for “maintenance issues, insufficiency, inadequacy, anomalies, or concerns,” and will notify the state “of the issues to assist […] with curing,” as stated in the “confidential memorandum of understanding” sent by the DOJ.

Illinois is one of at least 30 states and the District of Columbia that have been sued by the Department of Justice in an effort to force the release of voter data—which includes dates of birth, addresses, driver’s license numbers and partial Social Security numbers—in response to an executive order signed by President Donald Trump on March 25. At least six of those lawsuits have been dismissed.

In early April, a federal judge dismissed a U.S. Department of Justice lawsuit against Arizona seeking access to detailed voter records in the state, writing that Arizona’s statewide voter registration list is “not a document subject to request by the Attorney General” under federal law. The judge dismissed the lawsuit with prejudice because, she wrote, “amendment would be legally futile.”

Illinois AFL-CIO, Illinois Alliance for Retired Americans and Illinois Federation of Teachers filed a notice of supplemental authority on April 30 in support of their pending motion to dismiss the case against Illinois that cites the outcome of the lawsuit in Arizona.

“Yet another federal district court has now dismissed a near-identical complaint by DOJ against another state seeking the same type of information DOJ seeks here—this time in Arizona,” the notice reads in part. “That brings the total number of federal courts to have dismissed DOJ’s parallel complaints to six, and not one has yet to find that DOJ has stated a valid claim.”

The notice of supplemental authority is the most recent development in the lawsuit against Illinois, according to court documents.

While Illinois is still holding out on giving over voter data, at least 15 states have either provided or promised to provide detailed voter registration lists to the DOJ, according to the Brennan Center: Alabama, Alaska, Arkansas, Florida, Indiana, Louisiana, Mississippi, Nebraska, Ohio, Oklahoma, South Carolina, South Dakota, Tennessee, Texas, and Wyoming.
