BUFFALO, N.Y. — A federal judge ruled Tuesday that the federal death penalty trial for the suspected Tops mass shooter will take place in Buffalo.
The decision came after prosecutors argued that moving the trial would make it more difficult for the families of the victims to attend. Payton Gendron’s defense attorneys had requested to move the trial to Rochester, but the judge denied the request.
Ten people were killed in the racially motivated attack at a Buffalo Tops in May 2022. Gendron has already pleaded guilty to state charges.
Jury selection in the federal case is scheduled to begin on August 17.
