ROCHESTER, N.Y. — The families of two victims in the 2024 New Year’s Day crash outside of the Kodak Center, which police say was intentional, are accusing Kodak of not providing proper security.

The two estates have filed a lawsuit against Eastman Kodak, which owns the Kodak Center on West Ridge Road. The lawsuit claims the two deaths were caused by the “negligence, carelessness, recklessness, willfulness, wantonness, and conscious and deliberate disregard for the safety of others” by Kodak. The law firm Morgan & Morgan NY PLLC is representing the families.

Joshua Orr, 29, from Webster, and Justina Hughes, 28, from Geneva, died when a Syracuse man intentionally crashed his rental car outside the Kodak Center, according to Rochester Police. Orr and Hughes were in the back of an Uber.

The suspect, Michael Avery, also died in the crash, and RPD wasn’t able to determine a motive. Police say they found at least a dozen gas cans in his car, and he sped up as he approached people leaving the concert. The families of both victims released statements to News10NBC, remembering their kindness and love for music.

The lawsuit argues that Kodak failed to “hire, train, supervise, and retain” employees who could have protected the premises that night and prevented people from being killed. Attorneys claim that Kodak had an obligation to “take reasonable precautionary measures to minimize and make premises safe” as people come and go for concerts.
