This Point Reyes Precedent was completed under the Biden administration, not the Trump administration.
The Constitutional argument: Under the Supreme Court’s Major Questions Doctrine (West Virginia v. EPA, 2022), agencies cannot make decisions of “vast economic and political significance” without clear Congressional authorization. The Niman lawsuit (Case 3:25-cv-01976, N.D. Cal.) challenges this action. The Healthy Gulf litigation (Nov. 2025) challenges the offshore drilling extensions enabled by the same bypass mechanism.
