PENN YAN, N.Y. — Penn Yan Police arrested Xavia D. Miller, 26, and Daniel J. Smith, 39, after investigating the distribution of an intimate image.
Officials said Miller sent nude images of a victim to another person intending to cause emotional harm. The investigation revealed Smith, an inmate at the Yates County Jail, conspired with Miller to commit the crime.
Smith allegedly accessed the images and had Miller retrieve a cell phone from another inmate’s property containing the images.
Miller then shared the images with someone known to the victim. Miller was charged with unlawful dissemination or publication of an intimate image. Smith was charged with conspiracy in the sixth degree.
