ALBANY, N.Y. — A former prison guard acquitted of murder charges in the death of Robert Brooks is suing the state for $5 million.

Nicholas Kieffer, a former guard at Marcy Correctional Facility, claims his arrest was “maliciously made” and alleged the trial furthered the political agenda of the governor and state attorney general. Kieffer was one of several guards charged in the December 2024 beating death of inmate Robert Brooks of Grece and one of two cleared of all charges.

Kieffer’s lawsuit, filed Jan. 20, states that he and another guard “immediately went to the aid of a fellow officer who was struggling with an incarcerated individual” when Brooks did not comply with orders. Kieffer applied the minimum amount of pepper spray to Brooks’ head and neck “in accordance with DOCCS policy,” the suit claimed. Kieffer did not touch Brooks again that evening, according to the suit, and other guards were responsible for the assault that led to Brooks’ death.

Kieffer accuses the state of malicious prosecution, defamation, breach of contract, and negligence in training employees. He claims to have suffered public defamation, humiliation, threats of harm to himself and his family, loss of employment, and monetary damage.
