A Greeley police officer who shot a man during a burglary call in December will not face criminal charges.

In a letter to Greeley Police Chief Adam Turk about a police officer shooting Manual Cazares, 34, on Dec. 10, Weld County District Attorney Michael Rourke found the officer to have been justified in the shooting, according to a Weld County District Attorney news release. 

Greeley police responded to a burglary call Dec. 10 in the 2800 block of 16th Avenue and approached Cazares, who allegedly pointed a weapon at an officer. The officers shot at Cazares but did not hit him, before Cazares retreated into a residence. Police ordered Cazares to exit the home, which he did, but then he stopped complying with the police’s orders.

Cazares was shot and taken into custody.

The officer who shot Cazares was not identified in the release.

Cazares was taken to the Weld County Jail and arrested on charges of felony menacing and a protection order violation, according to Weld County arrest records. He is set to appear in court Feb. 5 for a disposition hearing.

Additional information about the case, including Rourke’s letter to Turk, is not available because Cazares is still being prosecuted.
