Erika Kirk has accused Tyler Robinson, the man suspected of killing her husband, Charlie Kirk, of attempting to delay his trial.
An attorney for Erika, 37, filed for a speedy trial in the case against Robinson, 22, on Friday, January 16, according to multiple reports.
“Nobody believed in the importance of the United States Constitution more than Charlie Kirk,” attorney Jeffrey Neiman wrote in the filing, 2KUTV reported. “And although the United States Constitution guarantees criminal defendants many rights, it does not guarantee them the right to cause undue delay.”
The paperwork also pointed out that Utah Code gives victims of a crime “the right to a speedy disposition of the charges free from unwarranted delay caused by or at the behest of the defendant,” according to ABC4.

“This court is tasked with the critically important function of ensuring the Defendant has a fair trial, but this Court must also do so while balancing Mrs. Kirk’s right to a speedy trial,” Neiman continued in the filing, the outlet reported.
The filing came on the same day as Robinson’s most recent appearance in court, where his defense team sought to disqualify the prosecution due to an alleged conflict of interest.
The defense argued that the Utah County Attorney’s Office should not be involved in the case because the daughter of a deputy county attorney attended the Turning Point USA event where Charlie, 31, was fatally shot on September 10, 2025.
“It’s with a heavy heart that we, the Turning Point USA leadership team, write to notify you that early this afternoon, Charlie went to his eternal reward with Jesus Christ in Heaven,” Turning Point USA, which was Charlie’s nonprofit organization, said in a statement at the time, confirming the political influencer’s death.

In September, prosecutors claimed they acquired an alleged text exchange between Robinson and his roommate, which allegedly revealed Robinson’s motive for the murder.
“I had the opportunity to take out Charlie Kirk and I’m going to take it,” the alleged text read. “I had enough of his hate. Some hate can’t be negotiated out.”

Robinson was charged with aggravated murder, felony discharge of a firearm and violent offense in the presence of a child. He is also facing two counts of obstruction of justice and witness tampering. He has not yet entered a plea. Prosecutors are reportedly considering the death penalty.
Robinson first appeared in court in December 2025. He seemingly kept calm as he smiled while sitting with his legal team.
