That effort was stopped from reaching the ballot when hearing officer Karen Goldman ruled the ordinance was administrative and could not be brought to a public vote under Colorado law. District Judge Allison Esser upheld this decision when the committee sought an emergency preliminary injunction.

Residents then formed Greeley Demands Better, led by Brandon Wark and Rhonda Solis, to repeal a zoning ordinance. The group gathered 4,554 valid signatures for the petition and then collected the additional 32 needed to bring the issue before the city council.

On Dec. 2, the council unanimously decided to schedule a special election for Feb. 24, 2026, at a cost of $350,000, to allow residents to vote on the zoning issue. Though repealing the zoning will not halt the project, critics of the project believe it will signal the public’s sentiment toward the project.
