ALBANY, N.Y. — The State has strengthened protections for reproductive healthcare and gender-affirming care with the signing of Shield Law 2.0 into law. Governor Kathy Hochul signed the bill, sponsored by Assemblymember Harry Bronson on Monday .
Shield Law 2.0 builds on the 2023 Trans Safe Haven Act by closing loopholes and preventing out-of-state overreach. It aims to protect individuals who provide or receive reproductive health care or gender-affirming care from criminal or civil liability outside of New York.
“With the passage of Shield Law 2.0, New Yorkers can now be assured that access to safe, reliable, lifesaving care from trusted providers is protected from retribution or punishment,” said Bronson.
The law prohibits the enforcement of subpoenas and investigations related to protected health care provided in New York without sworn affirmations that the information will not be used punitively. It also bars New York State-licensed attorneys from assisting with such subpoenas or investigations.
Submitting false affirmations will result in civil penalties, enforceable by the New York State Attorney General’s Office. Additionally, New York-based individuals and healthcare institutions are required to notify the Office of the Attorney General within five business days if they receive requests for protected health information, with many cases barring the release of that information.
Bronson expressed gratitude to various stakeholders, including Senate colleague Brad Hoylman-Sigal, Governor Hochul, Attorney General Letitia James, and organizations like NYCLU and Next Generation Men of Transition, for their commitment to this legislation.
