During day two, the court heard from the boy’s babysitter, who was watching him that night. She testified that she remembered getting woken up from her sleep unable to breathe and the room was all black.

She says she panicked trying to find the boy, Malakai, yelling his name before noticing the flames inside the home and on the stairs leading up to his bedroom.

Neighbors ran to the door in warning, and she asked them to call for help. She tried to go back inside, frantically searching the burning home to find Malakai, but everything was pitch black.

Once firefighters got there, she yelled to them where to find him. You could hear the babysitter beg the dispatcher to please hurry in the 911 call that was played in the courtroom Wednesday, yelling there was a kid inside.

Assistant District Attorney Kevin Sunderland said the call captured what happened in those moments for the jury.

“We want them to hear what people were feeling in those moments and what was actually being said, because I think it paints a truer picture of the horrible chaos that existed when that fire is happening. And so I hope that’s what they take from it, is the truth,” said Sutherland.

On the first day of her trial, members of the Rochester Fire Department and the first officers on scene testified in court. Sunderland said they expect there to be about 30 witnesses testifying during the trial.
