CHARLOTTE, N.Y. – A recent inspection report of Waterview Heights Nursing Center has raised serious concerns about the facility’s care, calling into question the deaths of four residents. The 113-page report highlights numerous issues, including residents being left in unsanitary conditions and the presence of Legionella bacteria in the facility’s water systems.

The report detailed that Legionella, a potentially deadly bacteria, was found in multiple water samples dating back to 2024. Despite this, the New York State Health Department was not notified, and no short-term control measures were documented. “Seventy percent of samples were positive for Legionella” in residents’ bathroom sinks and shared shower spaces, the report stated.

Seven residents fell ill, three of whom died, after being in areas where the bacteria was found. However, “there was no Legionnaire’s disease testing for those residents,” officials said.

Assemblyman Josh Jensen, representing Assembly District 134 and ranking member of the Assembly Health Committee, expressed his concern. “The loss of life is bad enough on its own, but if it’s because of the fault of the individuals who were working that facility, it’s angering,” Jensen said.

Jensen also emphasized the need for more oversight. “When we continue to hear time and time again about the failures to provide safe and adequate care, I think we should have someone from DOH (New York State Department of Health) in the facility every day,” he said.

The inspection report also revealed that the facility failed to provide adequate supervision for residents at risk of choking. One incident involved “Resident 308,” who was found unresponsive in front of the nurse’s station. The resident, who required a pureed diet and assistance during meals, had “an excessive amount of soft mush substance” come out of their mouth. The facility did not investigate whether a lack of supervision contributed to the death.

Jensen suggested that “maybe a more constant presence from health regulators would ensure a higher level of care.”

Deanna Dewberry of News10NBC reached out to the Department of Health regarding the possibility of taking over operations at Waterview Heights but has not yet received a response. The vice president of the Grand Healthcare System, which owns Waterview, stated that the facility made all corrections mandated by the Department of Health and performed well during a re-inspection. However, family members have reported that conditions have reverted to previous poor levels of care.
