Kellogg’s is known for dishing out popular brands like Fruit Loops, Apple Jacks, and Frosted Flakes.
But in April, it came under the radar of Texas Attorney General Ken Paxton.
Paxton accused the company of marketing its products as “healthy,” while allowing some of its cereals to be made with petroleum-based artificial food colorings.
The attorney general’s office claims these food colorings are “linked to hyperactivity, obesity, autoimmune disease, endocrine-related health problems, and cancer,” according to a press release.
Paxton said in the release, “A critical part of fighting for our children’s future is putting an end to companies’ deceptive practices that are aimed at misleading parents and families about the health of food products.”
“Artificial food colorings have been shown to have disastrous impacts on health, and in no world should foods that include these dyes be advertised as ‘healthy.’”
While several companies have voiced their commitment to removing certain ingredients from their products, Keloggs is the first to sign a legally-binding agreement to do so.
Paxton and Kellogg’s signed what’s known as an Assurance of Voluntary Compliance (AVC).

Kellogg’s legal agreement comes as FDA and Health Secretary Robert F Kennedy Jr. cracks down on companies for making food products with artificial food dyes and other ingredients deemed unhealthy.
And RFK Jr. has put his crosshairs on one particular food dye: Red Dye 40.
He is looking to eradicate it from America’s food products.
And that could have a major impact on the makers of products like Gatorade, Skittles, M&M’s, Flamin’ Hot Cheetos, and Mountain Dew Baja Blast.
FDA Commissioner Marty Makary has also voiced concern over Red Dye 40.
“For the last 50 years, American children have increasingly been living in a toxic soup of synthetic chemicals,” he said at a press conference.
And major retailers are already moving to comply with changing regulations.
Companies making ingredient changes
Smucker’s: Twinkies, Dunkin’ Donuts, Folgers Kraft Heinz: Heinz Tomato Ketchup, Kraft Mac & Cheese PepsiCO: Pepsi, Gatorade, Mountain Dew, Cheetos, DoritosWalmart-owned Sam’s Club is removing more than 40 ingredients from the private label brand Member’s Mark.
“We take pride in the high-quality ingredients that go into our products, but what truly differentiates us are the ingredients we consciously leave out,” Sam’s Club Chief Merchant Julie Barber said.
