Longmont fuel transport company Xtreme Petroleum LLC and owner Navkirat Singh face hundreds of thousands of dollars in potential penalties for allegedly tampering with emission-control systems on six vehicles, according to a Weld District Court lawsuit.
State attorneys also filed a request July 3 for a preliminary injunction against Xtreme Petroleum and Singh to stop operating two of the vehicles in Colorado until they can demonstrate that the vehicles comply with state requirements. Another preliminary injunction request calls for the defendants not to sell or offer to sell the two vehicles until the vehicles comply with state requirements.
The company and Singh face penalties of $49,500 plus interest and up to an additional $56,606 per day beginning April 3 for allegedly not complying with the Colorado Air Pollution Prevention and Control Act because of the tampering, according to the lawsuit. The Colorado Department of Health and Environment Air Pollution Control Division, represented by the state attorney general’s office, filed the lawsuit in Weld County District Court July 2.
State inspectors found that Xtreme and/or Singh owned 21 vehicles; six of which had emission control systems that were tampered with in violation of Colorado state law, according to the lawsuit.
“During the March (2024) inspections, Singh informed the Division that Xtreme personnel tamper with the emission control systems of Xtreme’s vehicles,” the lawsuit said.
Singh transferred four of the six vehicle titles out of state, according to the lawsuit. He still allegedly has two of the vehicles in Colorado.
“Defendants have waived any right to challenge the Compliance Requirements contained in the Compliance Order by failing to exhaust their administrative remedies through timely appeal of the Compliance Order to the Commission,” according to the lawsuit.
A man who answered the phone at the phone number listed at Xtreme Petroleum on Monday said he had no comment before hanging up.
