California is suing the Trump administration for federalizing the state’s National Guard early Sunday in Los Angeles, where protestors clashed with law enforcement during a series of protests concerning federal immigration raids.
The deployment was unauthorized by California Gov. Gavin Newsom, who wrote on social media that federal actions “inflam[ed] tensions while pulling resources from where they’re actually needed.”
State attorney general Rob Bonta announced California’s intent to file a lawsuit against the administration during a press conference earlier Monday.
“Since Trump announced his plan to deploy troops, the situation on the ground has escalated quickly with unrest growing overnight, causing highways to close and putting people in danger,” Bonta said.
“With this order, Trump and Hegseth ignored law enforcement’s expertise and guidance and trampled over our state California’s sovereignty.”
There are three specific triggers that could invoke the National Guard, according to Bonta, of which he said none were present.
Specifically, Title 10 of the United States Code allows a president to federalize a state’s national guard whenever there is a foreign invasion, a rebellion against the authority of the U.S., or when the federal government is unable to enforce federal laws.
The White House wrote, falsely, that recent protests against ICE “constitute a form of rebellion” when they “directly inhibit the execution of the laws” in justification of the deployment of 2,000 Nation Guard members.
Bonta emphasized the novelty of the federal administration’s actions during the conference, noting that this deployment is the first time since 1965 — when President Richard Nixon ordered the National Guard to deliver mail during a postal strike — that Trump activated the National Guard without a request from the state’s governor.
“We don’t take lightly to the President abusing his authority and unlawfully mobilizing California National Guard troops,” Bonta said.
“Activating these troops for protests that local law enforcement had confirmed at the time were under control is deeply unfair and disrespectful of their service and it pulls them away from critical work that needs and requires their immediate attention.”
