Beginning on Jan. 1, drivers in Colorado who enter and exit the express lane outside designated areas will face fines of up to $150.

This new rule follows a 30-day grace period in December, when the Colorado Department of Transportation says the state has issued more than 23,000 warnings to drivers in just the first 17 days. This new rule will address safety concerns as drivers are more likely to get into a collision with another vehicle when exiting or entering express lanes where they’re not supposed to.

“We’ve heard the public’s concerns about this unsafe driving behavior for years, and now we have the technology to hold these drivers accountable,” CDOT spokesman Tim Hoover said. “We’ve issued warnings for 30 days, but starting Jan. 1, violators will receive civil penalties in the mail if they continue driving recklessly.”

The Safety and Tolling Enforcement Program introduced this new rule last year on the I-70 Mountain Express Lane corridor and, after receiving positive results, has expanded it to include all of Colorado’s actively tolled lanes.

“This technology has already reduced violations by 80% in the corridors where we’ve deployed it,” Hoover said. “This means accidents avoided and lives saved.”

With the help of new software, cameras and roadway sensors, catching violators and enforcing the rules of the road will be easier for authorities. The fines for violators will start at $75 if paid within the first 20 days but will increase to $150 afterward.
